Anti Abuse Policy
We attach great importance to ensuring that the domain names, hosting services or other services we provide to our customers, resellers and their customers are legal and secure and that the risk of harm to Internet users is minimised.
We follow up meaningful indications of possible illegal, damaging or unlawful use of our services and take appropriate measures if necessary.
The following regulations apply in addition to the Anti Abuse Policies, Acceptable Use Policies or other policies specified by the respective registries, in which specifications are made regarding the permissible use of domain names, hosting services and other services as well as the procedures applicable in the event of a complaint.
It is the customer’s responsibility to ensure that the use of our services is lawful and safe. In principle, it is the customer’s duty to deal with third parties who provide information or make claims about the way in which the services are used. If third parties contact us or we are otherwise made aware of violations of this or other applicable policies, we may act in accordance with the provisions of this policy.
All services of Greenmark IT GmbH are provided on the basis of this policy. A breach of this Anti Abuse Policy also constitutes a breach of the contract for the registration of a domain, hosting service or the purchase of other services.
What we protect
We reserve the right to take measures, such as refusing, suspending, transferring or blocking our services, in order to
- – protect the integrity, security and stability of our services, the Internet and the Domain Name System (DNS);
- – to fulfil our obligations to act, for example based on court or official orders or policies from ICANN or registries;
- – counteract IT security threats;
- – to terminate, minimise or exclude a liability risk existing for us or
- – to terminate infringements.
Unauthorised uses
The following types of use in particular, but not exclusively, are deemed to be unauthorised uses which constitute a breach of this policy:
- 1. DNS abuse / technical abuse, i.e. phishing, pharming, malware, botnets and spam, insofar as this is used as a vehicle for the aforementioned forms of DNS abuse.
Malware is malicious software that is installed on devices without the user’s consent and either impairs their operation, spies on data or gains access to other computer systems. This includes spyware, ransomware, viruses and other unwanted software. Botnets are a network of computers connected via the Internet that have been infected with malware and are under the control of a third party to take action initiated by the third party.
Phishing occurs when a victim is induced/unconsciously forced to hand over data such as passwords, account details or logins. This is usually done through emails or websites that pretend to come from a trustworthy source such as a bank. Pharming means redirecting users to fraudulent offers or websites, for example through DNS cache poisoning.
- The infringement of third-party rights, such as the infringement of trademark, name or other labelling rights.
- Content that violates copyrights, competition law, the general personal rights of third parties (such as hate speech, racism, political defamation based on ethnicity and / or sexuality) or other legal provisions;
- Content relating to child abuse and/or child pornography and its distribution (Child Sexual Abuse Material (CSAM))
- Content relating to the sale and distribution of prescription drugs and/or substances subject to the German Narcotics Act (BtMG)
- All content that violates the provisions of German criminal law, and
- Other illegal content
Notices and procedure
Notices of a violation of this Anti-Abuse Policy must contain sufficient information to enable a review. This includes the domain name in question and, where permissible and appropriate, documentation of the content in question and an explanation of what is seen as a violation of the policy. Unless complaints are obviously unfounded or abusive, we will inform the complainant of the status of the investigation.
We also reserve the right to treat information from so-called trusted notifiers or via so-called abuse feeds, for example from Computer Emergency Response Teams (CERTS), as third-party input.
After checking the information, we forward it to the customer, reseller and, in exceptional cases, directly to their customer with a request to take appropriate measures. It may also be forwarded to hosting providers or other Internet infrastructure providers who can take action as a matter of priority.
As a rule, we set a deadline for feedback / remedial action of no less than two working days. However, if a customer website poses a threat, such as the spread of malware, we reserve the right to suspend services immediately.
If criminal content is involved, we reserve the right to file a criminal complaint. In the case of so-called Child Sexual Abuse Material (CSAM), information can also be provided to a hotline of the international INHOPE network, see (https://www.inhope.org/EN#hotlineReferral).
The customer, reseller and their customers are obliged to process and respond immediately to reports of a violation of this Anti Abuse Policy. With its response, the registrant shall clearly inform the registry or registrar whether it will remedy the infringement complained of or whether it wishes to defend itself against the claims of the third party.
Notwithstanding the above provisions, infringements are deemed to have been resolved if the registrant provides evidence that the infringements have been remedied within the relevant deadlines.
What we do not do
We do not check or monitor the legality of domain registrations, services or content offered by resellers or their customers..
